1. Jesmewlan Bengals are guaranteed for a period of 72 hours from the time the cat/kitten leaves Jesmewlan cattery. It is advised that owners take the cat/kitten to a qualified veterinary practice for a health check at the buyers expense.
If the kitten shows signs of illness within the 72 hour period, Jesmewlan will either offer a refund or a replacement cat/kitten of equal value as available; proof from a qualified veterinary practice will be required: This is at the buyer's expense. All return shipping charges are the responsibility of the buyer.
PLEASE NOTE: You only have the first 72 hours to vet check the above names cat/kitten; after this allotted period a replacement cat/kitten will apply - There are no exceptions - Please make sure you have read and understood this part of the contract.
Prior to any refunds or replacement animal being made, all papers issued with this animal must be returned, properly signed, transferring ownership back to the breeder. Please note; if the cat/kitten has been exposed to other cats/kittens not raised and bred by Jesmewlan, a proportion of the cat/kitten cost will be retained for FIP/FELV/FIV tests.
2. AT JESMEWLAN BENGALS WE FEEL VERY RESPONSIBLE FOR OUR CATS/KITTENS AND AS SUCH, WE WILL GIVE YOU THE FOLLOWING GUARANTEES:
The above named kitten is guaranteed to be free from congenital defects and genetic disease for a period of 12 months from the time of sale. Should a kitten die within this period , from the result of a congenital defect, Jesmewlan Bengals will replace the said kitten only if an appropriate autopsy is performed at the purchaser's expense and a licensed veterinary certificate is provided , showing proof of cause of death.
In the event that the above named kitten was found to have a congenital disease within the 12 month period, Jesmewlan Bengals will replace the kitten with one of equal value as available.
3. Jesmewlan female SBT Bengals sold on the active register are guaranteed to be fertile as adults given time and opportunity. It is understood that infertility will be defined as not succeeding in producing a litter of kittens by the time the cat is two years old, after having being bred to at least three different proven studs, and declared by a licensed veterinarian that she is in fact infertile. If any adult Bengal is found to be infertile, Jesmewlan will offer a replacement, but it will be the purchaser's responsibility to neuter the cat and place it in a responsible and loving home after seeking Jesmewlan's approval. Placing this cat on birth control voids any warranty of fertility.
4. All progeny from Jesmewlan cats sold on the active register shall not be sold on the active register without first seeking written permission from Jesmewlan Bengals (some lines subject to specific terms). Jesmewlan Bengals male cats sold on the active register will not be used as public studs. Any cat/kitten sold on the active register will not be sold on to a different cattery other than the one it has been placed unless it is homed as an altered pet with Jesmewlan's approval.
5. All registration documents for a pet Bengal kitten will be withheld by Jesmewlan until proof of neutering is provided by a licensed veterinary practice at the purchasers expense. The buyer agrees to neuter the kitten by the time it is 6 months old.
6. Sold as having show potential - The breeder cannot guarantee success in competition. Jesmewlan cannot guarantee the show career of a cat/kitten. By signing this contact, I, the purchaser totally agree to this statement and fully understand there are NO guarantees on how this cat/kitten develops after it leaves the breeders cattery. The breeder can only state show potential at the time of leaving the breeder's home.
7. If buyer becomes unable to keep cat/kitten for the remainder of its life, then buyer agrees to promptly notify Jesmewlan Bengals and must offer sellers (Madeline Williams & Virginie Gajewski) first refusal to have the cat/kitten back at no cost.
8. The seller warrants the cat/kitten is from a clean cattery and all vaccinations are up to date.
9. Under no circumstances are Jesmewlan Bengals cats/kittens to be sold to pet shops, research laboratories and animal brokers/agents or to be leased to third parties.
10. If at any time the above named cat/kitten is found to be in an unfit or abusive condition, to be determined by the seller, the seller reserves the legal right to remove the animal from the premises, and the buyer will surrender said animal and all appropriate papers to the seller, or to the seller's designated agent, immediately, unconditionally and without compensation.
11. Shipping: The Buyer is responsible for the cost of shipping (price to be arranged), airline-approved carrier, vet fees and health certificates. The breeder is NOT responsible for injury or stress related illness due to shipping/traveling, and/or mishandling during shipping. If the cat/kitten is shipped to a country with quarantine restrictions, no guarantees for illness from infectious air born diseases due to close contact with other animals will be given - The buyer will be aware of this.
The cat/kitten is sold in good faith.
12. The buyer agrees not to de-claw or de-meow this cat/kitten.
13.The buyer agrees to pay all court costs if this contract is litigated, and that any suit shall be tried in the seller's County and under seller's United Kingdom law. There will be an additional £1000 damages fee if this binding contract is brought to court.
Seller expects buyer to love, pamper and cherish above named cat/kitten and agrees to keep the seller informed of the cats/kittens welfare and progress.
14. Buyer also agrees not to criticise, defame or disparage Jesmewlan, its owners and associates, or its practices. Buyer agrees to bring any and all concerns directly to the seller without discussions with anyone else except professional resources such as their veterinarian or lawyer.
